Terms & Conditions

This website is owned and operated by Sparkle Fitness NZ Limited ("Sparkle Fitness"). These Terms set forth the terms and conditions under which you may use the website and services as offered by us. This website offers visitors information about and access to our personal training and fitness services. By accessing the website or purchasing the services, you confirm that you have read, understood, and agree to be bound by these Terms.​

Purchases

 

Any Personal Training session must be purchased in advance of any physical session taking place. 
Memberships must be paid in full in one month's advance by Online Payment. There are no refunds for Membership or package purchases.

When purchasing any of our services and participating in them, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices we charge for using the services are listed on the website. We reserve the right to change our prices for these services at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.

 

Cancellations

​

If you are unable to make a booked personal training session or other appointment service, these must be cancelled with at least 24 hours notice. If cancelled within this timeframe the appointment charge will still apply and there will be no refunds. This applies regardless of the reason for the cancellation. However, if Sparkle Fitness is unable to deliver the session then there will be no charge for the session.

NOTE: Rescheduling a session within the 24 hour window is the same as cancelling that session and the above policy and session fee will apply.

We may permanently or temporarily terminate or suspend any applicable membership without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment. Please refer to any specific conditions for your particular plan/membership.

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

10 Trip packages

​

10 trip personal training sessions can be purchased. Each 10 trip expires after 10 weeks of the date of the first session in the package. This is for clients who want to attend one personal training session per week. If you want to have 2 or more sessions per week then the 10 trip must be used within 5 weeks of the first session.

​

Missed sessions are able to be rescheduled before the expiry of the 10 trip block. This is subject to the trainer's availability. If the trainer is unavailable at the times you request then this does not result in a refund or roll over of those sessions to the next block. 

​

This policy allows for illness and holidays. If you have a holiday planned that is more than 2 weeks in length then you will need to consider whether you would be better purchasing a 10 trip or paying for singular sessions.

​

Your spot/time will not be held for you while on holiday unless you have an active 10 trip pass.

​

Coaching packages

​

The coaching packages are designed and purchased in 4 week blocks.

 

The coaching block rolls over automatically every 4 weeks, unless cancelled prior (with notice). The purchaser will receive a new 4 week block of training and the package benefits will renew every 4 weeks. Payment of the coaching fee is due in advance of the start of each 4 week block.

There is a minimum purchase of 3 training blocks. After 3 blocks the purchaser can cancel by giving notice. The notice period is 2 weeks before the end of the training block. Cancellations within 2 weeks of the end of a block will be effective after the end of the subsequent block.

 

Waiver
 

You understand that the fitness services provided by Sparkle Fitness have elements of high intensity and high impact exercise and that participating in physical activity can carry a risk, and you accept all responsibility for that risk. You acknowledge that it is your responsibility to provide us (in writing) with information regarding any medical condition that may affect your ability to exercise safely, and that you will not participate in any Sparkle Fitness services until this has been cleared by your Medical Professional. 


You acknowledge that before participating in any of Sparkle Fitness’s services, you must provide to us, written medical clearance from your Medical Professional if you have any medical condition that may affect your ability to exercise. Including, but not limited to:
CARDIOVASCULAR AND PULMONARY CONDITIONS:

Diagnosed heart condition or stroke, or unreasonable leg or chest pain during exercise.

Blood pressure over 200/110mm/Hg.

Diagnosed pulmonary disease.


You agree to inform Sparkle Fitness immediately if there are any changes in your health status.

Privacy Policy

 

We collect personal information from you, including information about your:

  • name;

  • contact information;

  • interactions with us;

  • billing or purchase information;

  • Medical and other health information; 

  • emergency contact information.

 

We collect your personal information in order to:

  • provide safe and effective personal training and wellness services;

  • contact your emergency contact if needed;

  • follow up on subscription payments;

  • provide promotional material and member information. If you do not wish to receive such material, please contact Sparkle Fitness to opt out of such communications. 

 

Providing some information is optional.

  • If you choose not to enter your contact details (for example), we'll be unable to provide in person personal training services because we will not know where to meet you. 

  • If you choose not to enter their relevant health information we'll be unable to provide in person personal training services because we will be unable to do so safely.

  • If you choose not to enter your account details we'll be unable to sign you up as a member.

 

We keep your information for as long as you are a member at which point we securely destroy it by deleting the member's account.

You have the right to ask for a copy of any personal information we hold about you, and to ask for it to be corrected if you think it is wrong. The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Sparkle Fitness. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.
