Terms & Conditions
This website is owned and operated by Sparkle Fitness NZ Limited ("Sparkle Fitness", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your use of our website, products, and services. By accessing our website or purchasing our services, you agree that you have read, understood, and accept these Terms.
Purchases

All personal training sessions must be paid for in advance of the session.

Memberships and packages must be paid monthly in advance via online payment.

All purchases are non-refundable.

By purchasing a service, you agree that:

You have reviewed all service details before making payment.

You enter a binding agreement when payment is completed.

We reserve the right to change prices at any time and correct pricing errors. For current prices and GST/tax information, please refer to our website or payments page.
Cancellations and Rescheduling

Sessions or appointments must be cancelled with a minimum of 24 hours’ notice.

Cancellations within 24 hours of the session are non-refundable, regardless of the reason.

Rescheduling within 24 hours is considered a cancellation and the session fee still applies.

If Sparkle Fitness is unable to deliver a session, there will be no charge.
10-Trip Packages

10-trip personal training packages expire 10 weeks after the first session.
-
If you train 2 or more times per week, the package must be used within 5 weeks.
-
Missed sessions can be rescheduled before the expiry date, subject to trainer availability. No refunds or extensions apply if mutually suitable times are unavailable.

Packages are priced to allow for short holidays or illness. If you plan a holiday of over 2 weeks, consider buying individual sessions instead.

Session times are not held during holiday periods unless you have an active 10-trip pass.
Coaching Packages

Coaching packages are designed in 4-week blocks. They are billed through online weekly payments. Invoicing and other payment methods can be accepted at Sparkle Fitness’s discretion.

A minimum 12-week commitment (3 blocks) is required for all coaching services.

Clients may pause their coaching for a maximum of 2 weeks per 24-week period, with prior notice.

Coaching plans auto-renew every 4 weeks unless cancelled with at least 2 weeks’ notice before the next block starts.

If notice is given within 2 weeks of the next block, cancellation will take effect at the end of that next block.
Race Smart 12-Week Programs (Crystal & Diamond)

Race Smart programs have a minimum 12-week commitment.
-
You may change from Diamond to Crystal at the start of any new 4-week block, and vice versa.

If you downgrade from Diamond to Crystal before completing 12 weeks, you are still required to pay a minimum total of $925 (equivalent to 3 Diamond blocks), which may extend the length of your commitment beyond 12 weeks until the amount is met.
Termination and Suspension
We reserve the right to suspend or terminate your services or membership, with or without notice, if you breach these Terms or applicable laws. You may cancel your membership or services at any time in accordance with the cancellation policies outlined above.
Waiver and Health Responsibility
By participating in any Sparkle Fitness service, you accept that:

Physical activity carries risks, including injury.

You are responsible for providing full and accurate health information prior to participating.

If you have any medical conditions, you must obtain written medical clearance before participating.
Examples of conditions requiring medical clearance include (but are not limited to):

Heart conditions, stroke, or chest/leg pain during exercise

Blood pressure over 200/110mmHg

Diagnosed pulmonary disease
You agree to update Sparkle Fitness immediately if your health status changes.

Contact emergency services if needed

We only collect information required to deliver our services. If you do not provide necessary information (such as health details or contact info), we may not be able to work with you.
Your data is securely stored and retained only while you are an active client. Afterward, it is deleted.

Intellectual Property
All materials and content on this website and within our services – including logos, videos, images, documents, training plans, and more – are the property of Sparkle Fitness and protected under copyright and intellectual property laws. You may not reproduce, share, or adapt any material without written permission.
Governing Law
These Terms and Conditions, and any disputes arising under them, are governed by the laws of New Zealand. By engaging in services with Sparkle Fitness NZ Limited, you agree to submit to the exclusive jurisdiction of the courts of New Zealand. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
